Authority The Artist authorizes the Website to: •advertise and market the Work(s) of Art on the Internet; •Art Online is not involved with the sale of artwork between an Artist and Buyer. •The Artist is responsible for any negotiations with Buyers to sell Work(s) of Art. Title The Artist has created the Work(s) of Art and possesses unencumbered title to all Work(s) of Art consigned by it to Art Online under this Agreement. The Artist warrants that they own all copyright in the content, or if not the owner, they have permission to use the content, and have the right to display, reproduce and sell the content. Sale of artwork Artists may sell artwork directly to Buyers in the following ways: 1.The Buyer initially contacts the Artist by completing an expression of interest form which is sent directly to the Artist. The Artist can then deal with the Buyer directly. Art Online will accept no responsibility for any sales undertaken directly between the Artist and Buyer. This relates to both 1 and 2 above. It is the Artist’s responsibility to ensure that details of artwork offered for sale are correct both in terms of availability and description of artwork. If a work of art has been sold, the Artist must notify Art Online in order to update the Website. The Artist shall notify Art Online of any artwork returns. Art Online’s Activities • To promote Work(s) of Art; Terms and conditions of Sale Art Online will accept no responsibility for any sales undertaken directly between the Artist and Buyer. Artists are responsible for their own sales policies. However, Art Online does expect Artists to follow the Artists Code of Conduct. If a Buyer is unsatisfied with an Artist’s sales policies, the Buyer should report the Artist to Art Online via email. Failure to follow the Artists Code of Conduct can lead to suspension of the Artist’s account. Art Online will not be held liable for Artists not following the Artists Code of Conduct. Images The Buyer agrees that the images of the Work(s) of Art on the Website are guidelines only. Art Online will accept no responsibility for differences between the Website Images and the actual Work(s) of Art. Delivery and Payment for works of art Art Online is not involved or responsible for any delivery or payments for the work of arts. Commission Art Online does not receive any commission for the sale of artwork. Delivery and Insurance All art purchase shipments are from the Artist to the Buyer. Art Online takes no responsibility for delivery services. Refunds and Return Policy Please see the Artists Code of Conduct. The Artist Code od Conduct are guidelines for the Artist. Art Online is not responsible for Artists following these guidlines. The Artist All dealings are subject to the consent of the Artist. The Artist warrants that he/she created and possesses unencumbered title to all Work(s) of Art under the Terms and Conditions of Sale. Title to the Work(s) of Art will transfer to the Buyer upon possession. Unless otherwise specifically indicated, the Work(s) of Art are originals, executed by the Member and are certified to be free from all defects due to faulty craftsmanship or faulty materials for a period of twelve months from the date of sale by the Artist. If flaws should appear during this period and be due to such causes, the Work(s) of Art shall be subject to repair or replacement, at the option of the Artist. The Buyer is cautioned, however, that the Artist cannot be responsible for fading, cracking, and other damage to these works caused by improvident exposure to sunlight and weather. Details important to any sale of an artwork are accurate and are communicated accurately to the Buyer before a sale takes place. Artists submitting artwork may not add any advertising on their artwork images and/or in the section "Artist's Comment". Art Online Art Online’s relationship to the Artist is as advertiser for the purpose of selling artwork consigned to Art Online. The Art Online reserves the right to refuse service to anyone at any time. The Art Online may, without incurring any liability to the Artist, at any time and from time to time, change the presentation of any of the Work(s) of Art or may cease to display or sell any of the Artist’s Work(s) of Art on the Website. Risk Risk in and all responsibility for the Work(s) of Art shall remain with the Artist subject to risk passing to the Buyer upon delivery. Dispute Resolution If any dispute arises between the Buyer and/or Art Online and/or the Artist the Buyer agrees to attempt to settle it by negotiation. A party may not serve an ADR notice or commence court proceedings/an arbitration until 21 days after it has made a written offer to the other party(ies) to negotiate a settlement to the dispute. Copyright and Trademark Information The Artist reserves all rights protected under Spanish copyright legislation in all Work(s) of Art purchased by the Buyer. The sale of the underlying work does not include the sale of rights to reproduction in any form unless specifically granted in writing by the Artist. Copyright sales are wholly the Artist’s privilege and an entirely separate transaction and not part of the underlying sale of the Work(s) of Art. By submitting to Art Online any images of artwork for sale on the Website (“Images”), you warrant and represent that you own all rights, including but not limited to all European Union copyright rights, in and to the Images. You grant to Art Online the worldwide, perpetual, irrevocable, royalty-free, sub licensable right and license to reproduce and prepare derivative works of the Images for the purpose of advertising the Images for sale on the Website. To the extent that you do not own all rights in and to the Images or that Art Online's use of any of the Images as permitted under this Agreement infringes or otherwise violates the rights of any third party, you agree to indemnify and hold Art Online harmless from any claims or demands, including attorneys’ fees and costs, incurred by Art Online with respect thereto. All images on the Website may not be reproduced or used in any manner without the express written permission of Art Online and, if appropriate, the relevant artist.

Privacy Policy Our commitment We are committed to protecting your privacy and promise to use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998. Information The type of information we will collect about you includes your name and e-mail address. If any information is inaccurate we will update our records accordingly. Emails Artists only receive emails from Art Online related to Art Online updates and newsletters Any requests to be removed from mailing lists will be processed without delay. Confidentiality We never share personal information related to subscribers or customers with third parties. Complaints If you wish to make a complaint about the use of personal information on Art Online please email us. Cookies Cookies are pieces of information that are stored by your Internet browser on your computer's hard drive. Art Online does not currently use Cookies to collect information on users. Our privacy Policy is regularly reviewed to ensure the security both of our site and your data.
